Civil Rights

Civil Rights are human rights. Martin Luther King stated "I am not unmindful that some of you have come here out of great trials and tribulations. Some of you have come fresh from narrow cells. Some of you have come from areas where your quest for freedom left you battered by the storms of persecution and staggered by the winds of police brutality. You have been the veterans of creative suffering. Continue to work with the faith that unearned suffering is redemptive.”

Civil Rights are the embodiment of fundamental liberties for everyone, which is articulated in the Constitution and federal law. When your rights are violated, there are legal options that you may pursue. Basic freedoms, when they are denied, can be monetarily compensated through aggressive legal action. Every citizen is entitled to Life, Liberty, Protection of Property and Due Process of law.

Lee & Harry is dedicated to protecting the civil rights of our clients. We do this by aggressively advocating for our clients and pursing compensation in court. This includes, but is not limited to, police misconduct, illegal search and seizure and racial profiling. We will file lawsuits on behalf of these clients and seek a just compensation for the violation of their Civil Rights.

Due process refers to the rights we have under the constitution. There is a process that must occur before some of those rights are taken away. Liberty and property cannot be taken away unless a specific process guarantees fair and objective treatment.  Due process must occur before an individual loses their right to liberty. The individual must have an opportunity to defend themselves and clear their name. If any of these conditions are not met, there could be a due process violation. As a result, any conviction, sentence, decision, or ruling may be void due to a lack of due process. Examples of Due process violations are confessions made under duress, which is a 5th amendment violation. The Fourteenth Amendment is the specific constitutional guarantee that no person shall be deprived of rights without due process. A person cannot be convicted or sentenced without a fair trial. The Sixth Amendment guarantees that individuals shall have a fair and impartial trial, including the assistance of appropriate legal counsel. If the aforementioned is not allowed, this is a serious due process violation.

The Constitution protects every citizen’s rights as described in the Fourth, Sixth, and Fourteenth Amendments. Enlisting the help of a skilled civil rights attorney is critical. An experienced attorney can help protect your rights, especially in situations of law enforcement abuse, ill treatment, and procedural inconsistencies.
